is it legal to use a remixed version of a copyrighted song for a telephone hold system?

i would like to know if you use a song for example Castlevania but a remixed version of it. does Nintendo still hold the rights to the remix even if they themselves did not create the remix?

2. Copyright lasts 70 years after the author's death, but since 'tendo holds all assets under their copyright, you will find this most difficult :V
